I think I have an answer to your second question. The Yamduttas are the equivalant of the "mesengers of death". Its their job to pick the soul from the body and take it to its destination.

In the above varta despite Vishnuji being a worshipper of Krishna he had also had the intention to steal Shivaji's food, which is considered as a dosh (sin). Additionaly we can see that despite being unaware he had fasted for Shivaji and lit the lamp for Him, and on this day Shivaji always bestows the fal if a person knowingly or unknowingly keeps the fast.

This is why both Shivaji and Krishna came to the soul after death to confirm its destination. So no doubt the Yamduttas must have been confused also and just trying to do their jobs.
